TERMS AND CONDITIONS OF THE ONLINE STORE FABRYCZNE.PL

§1 General Provisions

These Terms and Conditions define the rules for using the Store, including placing orders, payments, delivery, withdrawal from the contract, complaint procedures, and other rights and obligations of the Customer and the Seller.

The Store is addressed exclusively to consumers within the meaning of Article 22¹ of the Polish Civil Code.

§2 Definitions

Seller – FABRYCZNE.PL Tomasz Szuta
Customer – a natural person entering into a contract as a consumer
Goods / Service / Digital Product – services offered in the store, including multimedia system conversions, factory system upgrades, device repair services, activation codes for navigation maps
Store – the online service available at https://fabryczne.pl/
Distance contract – a contract concluded via the Internet
Civil Code – Act of 23 April 1964

§3 Ordering Process

Orders can be placed via the website https://fabryczne.pl/ 24/7.

The Customer selects a product/service and makes payment using available methods: card, BLIK, fast transfer.

After placing an order, the Customer receives an email confirmation.

For services requiring physical access to a device, the Customer may be required to deliver the equipment to the Seller’s premises or schedule an appointment.

For digital products, the Customer agrees to immediate execution of the order and acknowledges that this results in the loss of the right of withdrawal.

§4 Prices and Payments

Available payment methods:
a) online payments
b) card payments:

• Visa
• Visa Electron
• Mastercard
• Mastercard Electronic
• Maestro

c) other methods provided by the payment operator.

Online payment processing is handled by Autopay S.A.

All prices are in Polish zloty (PLN) and include VAT.

For custom services, the price is determined individually.

§5 Delivery and Service Execution

Order processing depends on the type of product or service.

Digital services (e.g. activation codes) are delivered electronically to the Customer’s email address – free of delivery charges.

For hardware submitted for repair or conversion, the following delivery options are available:
a) personal drop-off and collection – free of charge
b) courier delivery – from PLN 18.99
c) parcel locker delivery – from PLN 14.99

Delivery costs are always shown during checkout before order confirmation.

Processing time depends on the type of service and is agreed individually with the Customer.

Order processing time is calculated from the moment payment is received or the transaction is successfully authorized.

§6 Withdrawal from the Contract

The Customer has the right to withdraw from a distance contract within 14 days without giving any reason.

The period starts from the day of product delivery or conclusion of the service agreement.

To exercise the right of withdrawal, the Customer must send a clear statement (e.g. by email).

For services already started with the Customer’s explicit consent, the right of withdrawal may not apply (Art. 38 of the Consumer Rights Act).

According to Article 38 point 13 of the Consumer Rights Act, the right of withdrawal does not apply to digital products (e.g. activation codes) if performance has begun with the Customer’s explicit consent before the withdrawal period expired and after being informed about the loss of this right.

Refunds will be issued using the same payment method used by the Customer unless the Customer agrees otherwise.

A withdrawal form template is attached as Appendix No. 1.

§7 Complaints and Warranty

The Customer has the right to submit a complaint in case of non-compliance of goods or services with the contract.

The Seller will respond within 14 days.

All services come with a 24-month warranty from the date of completion unless otherwise stated.

For digital products (e.g. activation codes), complaints regarding malfunction or access issues are processed based on proof of purchase and description provided by the Customer.

The right of withdrawal does not apply to digital products if the Customer agreed to immediate execution and was informed about loss of this right.

Refunds will be made using the same payment method unless otherwise agreed.

§8 Personal Data (GDPR)

The Data Controller is FABRYCZNE.PL Tomasz Szuta, ul. Pomorska 17B, 84-230 Rumia, Poland.

Personal data is processed for:
a) order fulfilment and contract execution
b) handling complaints and returns
c) accounting and tax obligations
d) payment processing

Legal basis: Article 6(1)(b) and (c) GDPR (Regulation EU 2016/679).

Data may be shared with partners involved in order fulfillment and payments.

Customers have the right to access, rectify, delete, or restrict processing of their data.

§9 Final Provisions

In matters not regulated herein, Polish law shall apply, in particular the Consumer Rights Act and the Civil Code.

The Seller reserves the right to amend the Terms and Conditions for important reasons (e.g. legal changes, payment system changes).
